I – About the Terms and Conditions

I.1 - Scope of Application

These general terms and conditions (hereinafter referred to as "T&C" or "Terms and Conditions") apply to the services offered on the website https://holidog.com. The services offered on this site are provided by Holidog, a simplified joint-stock company under French law with a capital of 46,537.20 euros, registered in the Paris Trade Register under number 492 909 007 and headquartered at 54 rue de Paradis, 75010 Paris (hereinafter referred to as "Holidog"). The website operator is a US company headquartered at PO BOX 84023, Seattle, WA 98124-8423, USA.

I.2 - Definitions

Unless otherwise apparent from the context, the following terms and expressions in the contract have the following meanings:

  • "Pets" refers to dogs, cats, ferrets, rodents, rabbits, fish, birds, reptiles, horses and livestock.
  • "Box Shipment" refers to the monthly delivery of a box filled with high-quality products for dogs.
  • "Customer" refers to the natural person who uses a service offered by Holidog, valid for both the matchmaking service and the box shipment.
  • "Matchmaking Service" refers to the search and messaging functions aimed at connecting customers and pet sitters.
  • "Holidog" refers to the company Holidog, provider of pet services on the website https://holidog.com.
  • "Member" or "You" refers equally to the customer or pet sitter who has accepted these Terms and Conditions and uses the website as a customer or pet sitter.
  • "Parties" refers to Holidog and its members.
  • "Pet Sitter" refers to the natural person who offers a service on the website.
  • "Pet Care" refers to the care, walking, visiting or training services for pets provided by the pet sitter, as defined in Article II.1 of these terms.
  • "Services" refers to all services made available to members through the website, valid for both the matchmaking service and the box shipment. It should be noted that Holidog is in no case part of the pet care contract.
  • "Website" refers to the website https://holidog.com as well as any website or mobile application that, with Holidog's consent, adopts information from the website and offers similar services.
  • "T&C" or "Terms and Conditions" refers to the current general terms and conditions.
  • "User Account" refers to the account that must be created to become a member and access the offered services.

I.3 - Acceptance of Terms and Conditions via Internet

The use of this website and the services depends on acceptance of these Terms and Conditions, which are available on the website at all times. The T&C establish the rights and obligations of Holidog and its members (valid for all parties or for each party) regarding the various contracts offered on the website. When creating a user account, members must select the option "I accept the General Terms and Conditions of Sale". Only acceptance of the T&C allows members to use the services offered on the website. The Terms and Conditions must be accepted in their entirety. It is not possible for members to accept only a part or the T&C subject to reservations. By accepting the Terms and Conditions, the member agrees in particular to Article IV.3 of the T&C regarding the handling of members' personal data. By confirming registration, creating a user account, placing an order or concluding a subscription, the member confirms that they have read, understood and accepted without restrictions the mentioned conditions for registration, creation, ordering or concluding a subscription as well as the T&C in their entirety. Holidog reserves the right to delete a user account if a member violates the obligations provided for in the T&C.

I.4 - Modification of General Terms and Conditions

Holidog reserves the right to change the T&C, the offers on the website, or the operation of the services at any time. Changes to the T&C take effect immediately once they are published online after prior consultation by the members. Holidog reserves in particular the right to offer new services, both free and paid. The rejection of new T&C must in any case be explicit; without an express declaration of objection before the new provisions come into effect, the new T&C are considered accepted by the member.

I.5 - Use of the Service

To register and use the services offered by Holidog, each member must first create a user account and provide personal information about themselves that is essential for the smooth operation of the site (in particular surname, first name, age, gender, valid telephone number and email address as well as the characteristics of pet care if applicable). At the time of registration, the member must be at least 18 years old and have full legal capacity. The member is responsible for the information transmitted to Holidog through their user account and for its accuracy. If the information is incorrect, the member undertakes to correct it immediately or to inform a responsible person at Holidog. Holidog cannot be held responsible for any false or fraudulent information provided by members. The member undertakes not to create or use any other user accounts other than the one originally created, regardless of whether this is done in their own name or that of a third party. Any exception to this rule must be expressly requested by the member and expressly and specifically approved by Holidog. If a new user account is created or used in one's own name or that of a third party without expressly requesting and receiving permission from Holidog, this may result in immediate deletion of the member's user account and associated services.

II – About Holidog's Pet Sitter Matchmaking Service: GoHoliday, GoWalk, GoNanny and GoSchool

II.1 - Description of Services

Holidog offers a service for searching and connecting customers with pet sitters (hereinafter referred to as "Matchmaking Service"). The Matchmaking Service includes the following services: - The search and selection of pet sitters by the customer via a platform and - The connection of the selected pet sitter with the customer by Holidog. The Matchmaking Service enables the use of the following services provided directly by the pet sitter: - Care Service "GoHoliday": This service includes the care of your pet at your home or at the pet sitter's home while you are away. - Walking Service "GoWalk": This service includes walks in your area. - Visit Service "GoNanny": This service includes visits to your pet at your home or at the pet sitter's home while you are away. - Training Service "GoSchool": This service includes the provision of training sessions with a professional trainer or behavior specialist for your pet. The care, walking, visit and training services are hereinafter referred to either separately as "Pet Care" or collectively as "Pet Care Services". The Matchmaking Service offered by Holidog does not include the care, walking, visit or training service. These services are provided by pet sitters according to agreements made between the pet sitter and the customer. A contract template is available upon request from Holidog. Holidog also provides paid options for the following needs (hereinafter referred to as "Options"): - For customers: "Holivet" insurance - For pet sitters: "Premium Account"

III - About Holidog's Box Shipping Service: HappyBox

Holidog offers the shipment of a box containing high-quality products for dogs (hereinafter referred to as "Box Shipment").

IV - General

IV.1 - Access to the Website

Holidog strives to make the website available around the clock. However, access to the website or service may be interrupted due to maintenance work, uploading new material or implementing software, urgent repairs to the website, or circumstances beyond Holidog's control (such as failure of telecommunications connections or related equipment). Holidog will take all steps within its power and responsibility to minimize these interruptions. Members acknowledge and accept that Holidog assumes no responsibility if the website is unavailable, down or interrupted. Holidog assumes no liability for losses resulting directly or indirectly from this. In any case and without limiting the previous clauses on Holidog's responsibility, Holidog cannot be held responsible for compensation payments. Holidog's responsibility is limited to only the amount of fees paid for Holidog services.

IV.4 - Intellectual Property

The website https://holidog.com is the property of Holidog. All elements of this website, whether visual or audiovisual, texts, layouts, illustrations, photos, documents and other objects, including the underlying technology, are protected by copyright, trademarks and patents. Full or partial adoption of the website elements is strictly forbidden. The visitor to the website undertakes not to adopt any of the materials on the website. Any use of the entire website or parts or individual elements is an administrative offense that will result in criminal proceedings, and the illegal user must expect corresponding penalties.

IV.13 - Disputes

IV.13.a - Statute of Limitations

Any claim against Holidog regarding these terms must be made within one year. It is irrefutably assumed that the member waives a payment that was not requested within one year. This remains in Holidog's possession.

IV.13.b - Applicable Law and Jurisdiction

These terms are governed by French law, regardless of the customer's country of residence and conclusion of the contract. The application of the Vienna Convention on international sale of goods is expressly excluded. The court having jurisdiction is declared to be the one located in and having validity in the country where Holidog's headquarters is located.
